Rental Agreement – Sundance Ridge 36951 County Road 66 Crosslake, MN 56442 and Sundance Suites 36974 County Road 66 Crosslake, MN  56442

Check-In/Check-Out: Generally, the Accommodations will be available for occupancy beginning at 4:00pm or 5:00pm (Summer) on the Check-In/Arrival Date, and must be vacated by 11:00am or 10:00am (Summer) on the Check-Out/Departure Date.  A fee of $100 for every 30 minutes will be charged if unit is not vacated by above specified time.  Early Check-In or Late Check-Out may be granted by Sundance, whenever possible, prior to Arrival or during a stay.

This is a Non-Smoking Establishment: Evidence of smoking in a Condominium, Suite, Pool Building, Firehall or Clocktower will result in a $500 charge.

Grills:  Gas or charcoal grills or fire pits, or similar devices, used for cooking, heating, or any other purpose must not be utilized within 10 feet of any structure, including but not limited decks, or under any overhanging portion of any structure.  Failure to operate according to this requirement, or to return a Grill, after complete cooling to its storage place, will result in a $500 charge.

Pets: No pets are permitted without prior approval from Sundance. A “Pet Fee” and/or separate pet deposit may be required. Unauthorized pets will each result in a $500 additional charge.

Guest Responsibilities and Incidental Charges: The guest authorizes Sundance to charge the credit card used for payment and/or deposit if any of the following conditions are not met:

  1. No damage is done to unit or its contents, beyond normal wear and tear.
  2. No damage is done to the property or its amenities, beyond normal wear and tear.
  3. No broken or missing kitchenware.
  4. No irreparably stained, missing or damaged linens and towels.
  5. No charges are incurred due to contraband, pets or collection of rents or services rendered during the stay.
  6. All debris, cigarette butts, trash and discards are placed in dumpster on site.
  7. All soiled dishes are placed in the dishwasher and dishwasher started.
  8. All used white linens and towels are placed in the laundry room.
  9. All access/key cards are left on the kitchen counter.
  10. All doors and windows are closed and locked upon departure.
  11. The air/heat settings, while vacant, are turned to 65º F in the winter and 75º F in the summer upon departure.

The guest will be notified of these charges through one of the means of contact given at time of reservation. Charges will be based on the actual Total Cost, including Labor at $70 per hour, to repair and/or replace, or satisfy any applicable Damage/Incidental Charges, plus an administrative fee of 20% of the Total Cost.

Location/Maximum Occupancy: The guest will permit no more than the maximum occupancy listed on each Unit (10 Adults for Large Condos, 6 Adults for Small Condos). The guest agrees to pay $200 per night for each additional occupant not registered.

Payment: Payments are either due on a Month-to-Month basis, or a payment equal to 50% of the total is required upon placing the reservation. This payment will be applied toward the total amount of your stay. The advance payment is not a damage deposit. The BALANCE OF RENT is due fourteen (14) days before your arrival date. Please make payments in the form of Visa, MasterCard, Discover and/or American Express, or checks payable to SUNCOM, LLC.

Payment Terms: If a credit card is used for payment, then the Guest authorizes Sundance Ridge to charge any sums due under this Agreement to any credit card account held and provided by renter at the time of booking. The renter also authorizes Sundance to charge the balance due on the first of each month for which rent is due, or at 14 days prior to arrival unless another form of payment is agreed upon.

Cancellation and Refunds: Cancellation of an existing reservation can be submitted to Sundance at any time prior to the arrival date and still receive a refund of any payments made to Sundance towards the reservation. If a cancellation is a properly communicated to Sundance prior to date of arrival, the renter can receive a 90% refund of any payments already made, or 100% Credit towards a future Reservation.

House Rules: The Guest agrees to follow all house rules posted in the Accommodations or provided to the Guest prior to check-in. While using the Accommodations, the Guest will abide by all applicable governmental laws and regulations and will be responsible for all damage to the Accommodations beyond ordinary wear and tear. The Guest agrees to indemnify and hold Sundance Ridge harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the Accommodations by the Guest’s tenants, the Guests, or from any carelessness, neglect or improper conduct of any persons entering, occupying or visiting the Accommodations.

Sundance Ridge Pool Building and Firehall Gymnasium Rules: The Guest agrees to follow all posted rules in the pool building and gymnasium, lounge, and fitness rooms. The Guest agrees to shut off all the lights when they vacate the empty building. The Guest agrees to never prop or jam any of the doors open or ajar, doing so will result in a $50 service charge.

Trash Removal: The Guest agrees to deposit accumulated household trash in the Sundance Ridge or Sundance Suites refuse dumpsters and recycling bins located on site.

Utilities and Phone Service: The rent includes utilities (water, sewer, gas, electricity, satellite TV, and local telephone usage).

Unavailability of Accommodations: In the event that the Accommodations are unavailable for any reason beyond the control of Sundance (including, without limitation, acts of God such as fire, water damage or natural disaster), and if Sundance cannot secure comparable accommodations for the Guest, Sundance shall refund all the payments made to the Guest, and this Agreement will thereupon be deemed terminated. In no event shall Sundance be liable to the Guest beyond the return of any payments made towards the Guest’s reservation at Sundance.

Holdovers: If the Guest does not vacate in a timely fashion, the Guest will be subject to eviction and the rental amount due for any full or partial day following the specified check-out time in the amount of 150% of the Rack Rate monthly or daily rental fee.

Notices: Notice to either party shall be in writing to the mailing or email addresses shown at the top of this Agreement. Notice to the Guest during the occupancy period shall be by personal delivery to the Guest at the Accommodations.

Disputes: Any sums due from the Guest to Sundance shall accrue interest at the rate of 1.5% per month until paid. Any dispute relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of the State of Minnesota, and shall be governed by applicable Minnesota law. If Sundance hires legal counsel to enforce the terms of this Agreement or to resolve any dispute under this Agreement, the Guest shall be liable for all attorney’s fees and costs incurred by Sundance.
